Searle v the Commonwealth of Australia class Action

We the undersigned group members in the Class Action on behalf of MT2010 marine trainees, who were denied the training that was promised to them when they enlisted in the Royal Australian Navy, hereby entreat the Australian Government to recognise that we have been entitled to compensation for events which occurred as long ago as 2010 and for which the NSW Court of Appeal unanimously ordered that we were entitled to be compensated more than four (4) years ago, on 31st May, 2019.

We beg you, through your lawyers, at last to engage in good faith negotiations, to settle each of our claims on fair and equitable terms, having regard to the decisions of the NSW Court of Appeal in May, 2019 and of his Honour Justice Garling in the Supreme Court of NSW, delivered 16th June, 2023.

Please do so without delay.  We had to struggle through the Covid lockdowns without the benefit of the compensation which was due to us.

The Commonwealth as a “model litigant” needs to engage with us constructively so that this chapter in our lives can at last be closed.  

We are working men and women who enlisted in the Australian Defence Forces and are entitled to expect better treatment than we have received and that our Government should act with reasonable promptness to implement judicial decisions.
